Welcome to Palette & Place. We place original art, made in residence at remarkable houses, at the heart of everything we do, and we are committed to ensuring you have a clear and fair experience when using our Services.
Please read these Terms of Service and this Privacy Policy carefully. They contain important information about your legal rights, remedies and obligations.
YOUR ATTENTION IS PARTICULARLY DRAWN TO THE LIMITATIONS OF LIABILITY SET OUT IN CLAUSE 16.
By creating an Account, applying as an Artist or Host, purchasing Works, or otherwise using our Platform, you agree to comply with and be bound by these Terms of Service (as they may be amended from time to time). If you do not accept any of these Terms of Service, you should not become a Member or use our Platform. This document also includes our Privacy Policy, which applies to your use of our Platform and your membership.
Please use the Glossary to understand the meaning of some of the terms used in bold in these Terms of Service. Other terms are defined throughout these Terms of Service.

Part A — Terms of Service
1. Overview of our role and how the Services work
1.1. When we talk about “Palette & Place”, “we”, “our” or “us” in these Terms of Service, we are referring to Palette & Place Ltd, a company incorporated and registered in England and Wales, whose principal place of business is in Hove, East Sussex, United Kingdom.
1.2. Artists, Hosts and Collectors are together referred to as “Members” or individually as “you”.
1.3. We operate the website at paletteandplace.com (and any related domains, applications or services we make available) (“Platform”).
1.4. We provide a Platform that introduces Artists and Hosts for Residencies, publishes Works made in residence, and facilitates the sale of Editions and Commissions. Depending on the transaction, we may also provide scanning, proofing, printing, framing, shipping, payment collection and related fulfilment services.
1.5. We do not employ Artists or Hosts. A Residency is a private arrangement between an Artist and a Host, facilitated by us. Except where we expressly state otherwise (including in relation to the sale of Editions and Commissions through the Platform), we are not a party to any agreement you may make with another Member about a Residency.
1.6. In consideration of Members paying any applicable Fees (as set out in clause 7) and complying with these Terms of Service, we will provide the following services (“Services”):
1.6.1. hosting and maintaining the Platform to enable Hosts to list their properties and offer Residency dates;
1.6.2. hosting and maintaining the Platform to enable Artists to apply, create profiles, and be matched with Hosts for Residencies;
1.6.3. publishing Works and enabling Collectors to browse, purchase Editions and enquire about Commissions;
1.6.4. where applicable, scanning, colour proofing, printing, framing, shipping and customer support for Editions and Commissions;
1.6.5. collecting and distributing payments arising from sales of Editions and Commissions in accordance with the revenue shares stated on the Platform (or in a separate written agreement with you); and
1.6.6. making the content on the Platform available to Members and visitors.
1.7. We will provide the Services for the period of your Account or membership plan, or for the duration of any specific order or engagement, as applicable.
2. Separate agreements between Members
2.1. When you arrange a Residency via our Platform, you are entering into an agreement between yourself and an Artist or Host (as applicable). That arrangement typically involves the Host providing accommodation for a short period and the Artist producing Work at the property. It is not an employment contract and does not create a relationship of employer and employee, worker and hirer, or (as between Artist and Host) service provider and recipient in the employment sense, unless you separately agree otherwise in writing.
2.2. It is your responsibility to ensure that the requirements of a Host Listing or Artist Profile, and any Residency brief we facilitate, align with your expectations. We may provide guidance on how Residencies work; that guidance is for information only. Arrangements you reach with another Member form part of the separate agreement between you.
2.3. Except for sales of Editions and Commissions processed through the Platform (where we act as seller or agent as described on the Platform at the point of purchase), we are not party to any agreement, contractual or otherwise, between an Artist and a Host regarding a Residency.
2.4. You should use your best judgement before arranging a Residency or otherwise interacting with other Members via the Platform. You are solely responsible for making decisions that are in your best interests, including in relation to properties, travel, insurance and suitability of another Member.
3. The Services we provide for Members
In addition to the services described in clause 1, we provide the other services set out in this clause.
3.1. The services we provide for Hosts include:
3.1.1. the ability to create a Host Listing and offer Residency dates;
3.1.2. introductions to vetted Artists for Residencies;
3.1.3. the ability to communicate with Artists via the Platform (where messaging is available);
3.1.4. receipt of the Original Work produced during a Residency, subject to the Artist completing the Work and our fulfilment processes;
3.1.5. a share of margin on Editions and Commissions sold from Works associated with the Host’s property, as stated on the Platform;
3.1.6. Membership Support; and
3.1.7. such other features as we make available from time to time.
3.2. The services we provide for Artists include:
3.2.1. the ability to create an Artist Profile and apply for Residencies;
3.2.2. introductions to Hosts offering Residency dates;
3.2.3. the ability to communicate with Hosts via the Platform (where messaging is available);
3.2.4. scanning, colour proofing, printing, framing and shipping support for Editions of their Works (subject to approval of proofs where required);
3.2.5. a share of margin on Editions and Commissions, as stated on the Platform;
3.2.6. Membership Support; and
3.2.7. such other features as we make available from time to time.
3.3. The services we provide for Collectors include:
3.3.1. the ability to browse Works, Editions and related content on the Platform;
3.3.2. the ability to purchase Editions and enquire about Commissions;
3.3.3. fulfilment of purchased Editions (printing, framing where selected, and shipping) as described at checkout; and
3.3.4. customer support in relation to orders placed through the Platform.
4. The Services we do not provide to Members
4.1. We do not provide the following or any guarantees or assurances for any of the following:
4.1.1. the safety, condition or suitability of a Host’s property;
4.1.2. confirmation that a Residency will proceed on particular dates, or at all;
4.1.3. that any Host Listing or Artist Profile will be approved by us;
4.1.4. that you will be matched with another Member for a Residency;
4.1.5. that any Edition or Commission will sell, or will sell in any particular volume or timeframe.
4.2. We do not provide any of the following:
4.2.1. house-sitting, pet care, or property management services;
4.2.2. employment of Artists or Hosts;
4.2.3. travel, medical, public liability or home insurance for Members (you must arrange your own insurance as appropriate);
4.2.4. independent verification of every statement in a Host Listing, Artist Profile or Review;
4.2.5. endorsement of the artistic quality, commercial success or performance of any Member, beyond any curation process we expressly describe on the Platform.
4.3. Any “plans”, goodwill payments or discretionary support we may offer from time to time are not insurance policies and are not intended to replace insurance you obtain yourself. We are not authorised or regulated as an insurance provider.
5. Requirements of Members
5.1. The following applies to all Members. You will:
5.1.1. be an individual who is at least 18 years old (or a duly authorised representative of a business or organisation, where we permit business Accounts);
5.1.2. pay all amounts owing under these Terms of Service on time;
5.1.3. comply at all times in full with these Terms of Service;
5.1.4. register for an Account on the Platform (where required) and provide accurate information about yourself which you will keep up to date. Our collection and use of your personal information is described in Part B (Privacy Policy);
5.1.5. keep your login and password details confidential and prevent any unauthorised access to, or use of, the Services via your Account;
5.1.6. promptly notify us of any unauthorised use of your Account;
5.1.7. not create a fake identity or impersonate anyone else;
5.1.8. only upload images and other content in formats, sizes and resolutions we specify;
5.1.9. respond to communications from us and from other Members in a timely manner;
5.1.10. not access or use all or any part of the Platform or Services to build a product or service which competes with the Services or the Platform, nor use the Platform solely to arrange Residencies or sales with Members outside the Platform in order to avoid Fees;
5.1.11. not attempt to copy, modify, transmit or distribute all or any portion of the Platform (including any software) in any form or media or by any means, except as expressly permitted;
5.1.12. provide accurate emergency or contact information where we request it in connection with a Residency or order; and
5.1.13. not use the Platform from a jurisdiction that is subject to applicable sanctions or that our payment providers have deemed high risk.
5.2. The following applies only to Hosts. You will:
5.2.1. ensure that the details of your Host Listing are accurate and up to date, including location, accommodation, access, house rules and any hazards;
5.2.2. evaluate the suitability of Artists for yourself via communication facilitated by us where appropriate;
5.2.3. ensure you have adequate home insurance and that your insurer is informed, where required, of short stays by Artists;
5.2.4. ensure the property is reasonably safe, clean and available for the Artist throughout the agreed Residency dates, and that no third parties unreasonably interfere with the Artist’s stay and work;
5.2.5. disclose prior to the Residency any recording or monitoring devices, weapons, or other material risks on the premises, and ensure weapons are properly secured;
5.2.6. not require the Artist to perform house-sitting, pet care, cleaning or other services beyond painting and reasonable care of the space they occupy, unless separately agreed in writing;
5.2.7. accept that the Original Work produced during the Residency becomes your property once completed and delivered in accordance with our process, while copyright remains with the Artist as set out in clause 12; and
5.2.8. cooperate with scanning, proofing, hanging and plaque placement as reasonably requested so Editions can be offered for sale.
5.3. The following applies only to Artists. You will:
5.3.1. abide by the Host’s reasonable house rules and any Residency brief agreed via the Platform;
5.3.2. abide by all immigration rules and local laws of any country you visit while carrying out a Residency;
5.3.3. produce at least the number and type of Works required for that Residency (typically one finished, signed Work on paper unless otherwise agreed);
5.3.4. approve colour proofs within a reasonable time when requested, so Editions can be produced;
5.3.5. not demand payment from a Host for the Residency stay itself beyond the terms of the exchange (accommodation for Work), except for separately agreed Commissions or expenses we approve;
5.3.6. treat the Host’s property with care and immediately notify the Host (and us, where material) of any damage;
5.3.7. have suitable travel and medical insurance in place before a Residency;
5.3.8. only upload Member Content that accurately reflects your practice and experience;
5.3.9. not allow other persons to stay at the property during a Residency unless approved by the Host; and
5.3.10. grant the reproduction licences described in clause 12 so we can produce and sell Editions.
5.4. The following applies only to Collectors. You will:
5.4.1. provide accurate delivery and billing information for orders;
5.4.2. pay the price stated at checkout, including any shipping, framing and taxes shown; and
5.4.3. use purchased Editions for personal use unless we agree otherwise in writing (commercial licensing is available on request).
6. Consequences of not complying with requirements for Members
6.1. If a Member does not comply with the requirements in clause 5, we may:
6.1.1. issue you with a warning;
6.1.2. suspend your Account so you will not be able to access the Services during the suspension;
6.1.3. permanently block your access to the Services;
6.1.4. remove or refuse Host Listings, Artist Profiles, Works or Member Content;
6.1.5. immediately terminate your membership;
6.1.6. withhold or set off Fees or payouts to the extent permitted by law where you owe us amounts or have caused loss; and/or
6.1.7. report any offences to the appropriate authority.
6.2. The application of these sanctions is entirely at our discretion and we can choose whether to apply any one or all of them at any time.
7. Fees, revenue shares and payments
7.1. Fees and revenue shares applicable to Artists, Hosts and Collectors are as stated on the Platform at the relevant time (including on application pages, Host and Artist terms summaries, and at checkout), or in a separate written agreement with you. Current founding-season commercial terms for Artists and Hosts may include (without limitation) Artist and Host shares of print and Commission margin; those figures may change for future seasons on notice.
7.2. Where we introduce membership or subscription plans, you will pay the Membership Fee stated on the Platform. Membership terms, billing intervals and Auto-Renewal (if any) will be described at the point of purchase.
7.3. All amounts and fees stated or referred to in these Terms of Service shall be payable in the currency available and selected on the Platform (typically pounds sterling for UK sales).
7.4. Where Auto-Renewal applies, we will take payment at the end of the current term unless you cancel in accordance with the instructions on the Platform or by emailing hello@paletteandplace.com at least seven (7) days before the renewal date. We will aim to email you at least thirty (30) days prior to Auto-Renewal.
7.5. We may increase the price of any of our Services at any time. Where a price increase affects an ongoing membership or recurring Fee, we will aim to give you at least thirty (30) days’ notice by email.
7.6. Payments made under these Terms of Service may be processed by a third-party payment provider (for example Stripe). Your payment data will be handled in accordance with Part B (Privacy Policy) and the provider’s terms.
7.7. Payouts to Artists and Hosts of their share of margin will be made on the schedule stated on the Platform (for example monthly), subject to successful receipt of Collector payment, any refunds or chargebacks, and our right to withhold amounts reasonably required to cover disputes or breaches.
7.8. You are responsible for any taxes applicable to your income from Residencies, Editions or Commissions. Prices shown to Collectors include VAT where required by law, as indicated at checkout.
8. Orders, Editions and Commissions
8.1. When a Collector places an order for an Edition through the Platform, a contract for sale is formed as described at checkout (which may be between the Collector and us, or between the Collector and the Artist with us acting as agent — we will make this clear at the point of purchase).
8.2. Editions are typically limited (for example editions of 25), signed and dated, and offered framed or unframed as stated on the Work page. Stock and edition numbers are as displayed at the time of purchase.
8.3. Commissions are subject to a separate brief, price and timeline agreed in writing (including by email or Platform message). Work on a Commission does not begin until any deposit we require has been paid.
8.4. Shipping times (for example framed Editions shipping within a stated number of days) are estimates. We are not liable for delays caused by carriers, customs, or events outside our reasonable control, though we will use reasonable efforts to keep you informed.
8.5. Risk in goods passes to the Collector on delivery to the address provided. Title passes on full payment.
8.6. If payment fails, we may suspend or cancel the order until payment is completed.
8.7. We may apply temporary promotions, waivers or incentives from time to time.
9. Cancellation, cooling-off and refunds
9.1. Membership Fees. If you purchase a membership or subscription, we will refund the Membership Fee if you notify us within fourteen (14) days of the Activation Date that you wish to cancel, unless you have already used membership benefits in a way that means the service has begun (for example, confirmed a Residency, published live Host dates, or completed a purchase using member-only pricing), in which case your cooling-off rights may be lost to the extent permitted by law.
9.2. Editions (consumers in the UK/EU). If you are a consumer, you may have a statutory right to cancel distance contracts within fourteen (14) days. That right does not apply to personalised goods, or to goods made to your specification, once production has begun with your agreement. Limited Editions that are printed and framed to order after purchase are typically made to order; by placing an order you request that we begin production, and you acknowledge you may lose the right to cancel once production has started. Damaged or faulty goods will be replaced or refunded in accordance with your statutory rights.
9.3. Commissions. Deposits for Commissions are non-refundable once work has begun, except where we cancel or as required by law. Final balances are due as stated in the Commission brief.
9.4. Residencies. Cancellation of a Residency by an Artist or Host should be notified to us and the other Member as soon as possible. We are not obliged to refund any Fees already earned or to compel another Member to proceed. We may, at our discretion, help rematch Members.
9.5. Any refund we agree will be made to the original payment method unless we agree otherwise.
10. Term and termination
10.1. Your Account continues until you close it or we terminate it in accordance with these Terms of Service.
10.2. If membership plans apply, they run for the fixed period stated at purchase and renew in accordance with clause 7 unless cancelled.
10.3. If we terminate your membership in accordance with clause 6, you will not be entitled to a refund of Fees already paid, except where required by law.
10.4. We reserve the right to suspend or terminate your access to the Platform and/or Services at our sole discretion where reasonably necessary to protect the Platform, other Members, or our legitimate interests. Whether or not we terminate will not affect any other rights or remedies which you or we may have.
10.5. On termination, licences you granted us to Member Content survive to the extent needed to fulfil existing orders, maintain provenance records, and as otherwise set out in clause 12.
11. Content and Platform ownership
11.1. You acknowledge and agree that we own all intellectual property rights in the Platform and/or Services, including (i) the technology and software used to provide them; (ii) the content on the Platform (save in respect of Member Content and Works, as addressed below); and (iii) our trademarks and logos. You do not acquire any intellectual property rights in the Platform or Services except the limited right to use them in accordance with these Terms of Service.
11.2. Copyright in Works. Copyright in original Works created by an Artist remains with the Artist. The Artist grants Palette & Place an irrevocable, perpetual, non-exclusive, royalty-bearing (via the revenue share), worldwide licence to reproduce, adapt for print production, publicly display, distribute and sell Editions of the Work, and to use images of the Work to operate and promote the Platform and Services. The Host receives ownership of the physical Original Work as part of the Residency exchange, but does not acquire copyright unless the Artist agrees otherwise in writing.
11.3. Member Content that you provide or upload to the Platform belongs to you. You confirm that you have created it (or have all rights necessary to upload it) and that our use will not infringe the rights of any third party. If you infringe third-party rights and we suffer loss, you may be required to compensate us.
11.4. You grant us an irrevocable, perpetual, non-exclusive, sub-licensable, royalty-free worldwide licence to use, copy, perform, publicly display, reproduce, adapt, modify, transmit, broadcast, prepare derivative works of, and/or distribute Member Content in connection with providing and/or promoting the Platform and the Services.
11.5. You assign to us with full title guarantee all intellectual property rights in Feedback, Reviews and References (“FRR Content”) and waive any moral rights in FRR Content to the extent permitted by law. We may edit or delete FRR Content.
11.6. Member Content and listings are not independently verified by us in full. Reliance on them is at your own risk. Use your own judgement.
11.7. We may remove any content you upload if, in our opinion, it does not comply with these Terms of Service or applicable law.
11.8. If you believe content on the Platform is inappropriate, defamatory or infringing, contact us at hello@paletteandplace.com.
12. Disputes between Members
12.1. We may, at our discretion, help Members resolve disputes relating to Residencies, Works or sales. We are not obliged to mediate and our involvement does not make us a party to the underlying dispute between Members, except where the dispute concerns an order we fulfilled.
12.2. For order disputes (damage in transit, wrong item, quality of print), contact us first at hello@paletteandplace.com with your order reference.
13. Your rights
13.1. As a consumer, you have legal rights in relation to the Platform and/or Services. Advice about your legal rights is available in the UK from Citizens Advice or your local Trading Standards office.
14. Other important terms
14.1. These Terms of Service are a contract between you and us and only you and we have the right to enforce them (except that Artists and Hosts may enforce revenue-share and licence provisions intended to benefit them).
14.2. You agree that you are not our employee, partner, agent or legal representative of any kind, unless we expressly appoint you in writing. You will not make statements or take actions that could legally bind us.
14.3. If we do not take action against you, that does not mean we waive any rights we may have.
14.4. If any part of these Terms of Service is found to be invalid, unenforceable or illegal (“the Offending Part”), the Offending Part will be severed but the remaining provisions will remain in full force and effect. If possible, the Offending Part will be modified so as to give effect to the intention of the parties.
14.5. You will not assign or transfer any of your rights or obligations under these Terms of Service without our prior written consent.
14.6. We may at any time assign, transfer, charge, sub-contract or deal in any other manner with all or any of our rights or obligations under these Terms of Service, provided that your rights and obligations are not materially adversely affected.
14.7. We may amend these Terms of Service from time to time. We will aim to give you advance notice of any major changes. Continued use of the Platform after changes take effect constitutes acceptance of the updated terms.
14.8. On termination of these Terms of Service, the clauses that reasonably should survive termination will remain in effect (including clauses relating to intellectual property, liability, indemnity and privacy).
14.9. Any notice we give you will be sent by email to the email address linked to your Account, or to the email you used when contacting us.
14.10. If we cannot perform the Services because of events beyond our reasonable control (including strikes, utility or network failure, act of God, war, riot, civil commotion, malicious damage, compliance with law, accident, fire, flood or storm), we will suspend the Services for the duration of that event. If the event cannot be resolved in a reasonable period, we may cancel affected Services and refund any prepaid Fees that relate solely to the future period we have cancelled, where fair and required.
15. Law and where to bring proceedings
15.1. These Terms of Service shall be governed and construed in accordance with the laws of England and Wales. This does not exclude any mandatory legal rights you may have in your country of residence where we are not allowed to exclude them. The courts of England and Wales will have jurisdiction, without prejudice to your right to bring a claim in your country of residence where you have that right as a consumer.
16. Limitation of liability
16.1. Please read this clause carefully. It sets out what we do and do not accept responsibility for.
16.2. We provide a Platform for Members to find and connect with each other for Residencies, and to buy and sell Editions and Commissions. Except where we expressly undertake fulfilment or act as seller, we are not involved in the day-to-day performance of a Residency and are not a party to Residency agreements between Artists and Hosts. The responsibilities and liabilities we assume reflect that role.
16.3. We may curate or vet Artists and Hosts as described on the Platform, but we do not guarantee the character, reliability or suitability of any Member. Badges, approvals or introductions are not warranties of quality or outcome.
16.4. We try to make sure that the Platform is accurate, up to date and free from bugs, but we cannot promise that it will be. We cannot promise that the Platform will be fit for any particular purpose. Reliance on Platform information is at your own risk.
16.5. Content on the Platform is for general information. It does not constitute technical, financial or legal advice.
16.6. The Platform may contain links to third-party websites or advertising. We have no control over those sites and accept no responsibility for their content. Your use of third-party sites is at your own risk and may be governed by their terms.
16.7. We do not accept any liability or responsibility for the following (to the maximum extent permitted by law):
16.7.1. bank or card charges you incur in connection with Fees or refunds;
16.7.2. loss of income, loss of anticipated sales, or extra costs arising from a Residency or from the performance or non-performance of a Residency;
16.7.3. retention, deletion or loss of your Member Content (maintain your own backups);
16.7.4. acts or omissions of third-party agents or subcontractors except to the extent we remain responsible for Services we have contracted to provide to you;
16.7.5. anything related to the services we make clear we do not provide as set out in clause 4.
16.8. You assume full responsibility for the choices you make before, during and after a Residency or purchase, including evaluating suitability of another Member, travel and subsistence, health and safety at a property, care of property and belongings, and information you share with other Members. We have no liability to you in respect of those risks except as set out in this clause 16.
16.9. To the maximum extent permitted by law, we are not liable for injury, death, loss or harm occurring during a Residency or related to a Residency, except where caused by our negligence or as otherwise non-excludable.
16.10. In no event shall we (including our employees, agents and subcontractors) be liable for losses arising out of your breach of these Terms of Service or if you fail to follow reasonable instructions we give you.
16.11. Nothing in these Terms of Service excludes or limits our liability for:
16.11.1. death or personal injury caused by our negligence;
16.11.2. fraud or fraudulent misrepresentation;
16.11.3. intentional misconduct of our employees; or
16.11.4. any other liability that cannot be excluded by law (including under the Consumer Rights Act 2015).
16.12. We are responsible for loss or damage caused by us that is foreseeable as a result of us breaching these Terms of Service or failing to use reasonable skill and care. We are not responsible for loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us when these Terms of Service were entered into.
16.13. Subject to clause 16.11, our maximum aggregate liability to you under these Terms of Service is limited to the greater of: (a) the total Fees you paid to us in the twelve (12) months before the event giving rise to the claim; or (b) one hundred pounds sterling (£100).
16.14. You will reimburse us for all losses and expenses we suffer as a result of a third party bringing a claim against us due to your breach of these Terms of Service.
Glossary
Account means the Member area on the Platform accessed with secure login details.
Activation Date means the date a membership or subscription Fee is first successfully paid and the plan is activated.
Artist means a Member who applies to, or undertakes, Residencies to create Works at Host properties.
Artist Profile means the profile of an Artist on the Platform.
Auto-Renewal means automatic renewal of a membership or subscription at the end of its term unless cancelled.
Collector means a Member or visitor who browses or purchases Editions or Commissions.
Commission means a bespoke artwork commissioned via the Platform, typically of a view or place agreed in a brief.
Edition means a limited, numbered reproduction of a Work offered for sale through the Platform (for example an edition of 25), which may be signed and dated.
Fees means any amounts payable to us under these Terms of Service, including Membership Fees, order totals, and any other charges stated on the Platform.
FRR Content means Feedback, Reviews and References.
Host means a Member who lists a property and offers Residency dates to Artists.
Host Listing means the listing on our Platform describing a Host’s property and Residency offering.
Member means an Artist, Host or Collector (as applicable).
Member Content means content (including text, photographs, images, videos and other materials) that you upload relating to your profile, listing or use of the Platform, excluding the copyright in Works which is addressed in clause 11.
Membership Fee means any subscription or membership charge payable for access to particular Services.
Membership Support means our customer support for membership, Platform use and Services.
Original Work means the physical original artwork produced during a Residency, which becomes the Host’s property as part of the exchange.
Platform has the meaning given in clause 1.
Residency means the arrangement under which an Artist stays at a Host’s property for a short period and creates Work.
Review(s) means comments or ratings left by Members about Residencies, Works or experiences.
Services has the meaning given in clause 1.
Work means an original artwork created by an Artist in connection with a Residency or Commission.
Part B — Privacy Policy

18. Personal data we collect
18.1. We may collect:
18.1.1. Identity and contact data — name, email address, phone number, postal address, account credentials;
18.1.2. Profile and application data — Artist portfolios, Host property details, eligibility information, preferences and communications;
18.1.3. Transaction data — orders, Residencies, payouts, invoices, payment status (payment card details are typically processed by our payment provider and not stored in full by us);
18.1.4. Technical data — IP address, browser type, device information, pages visited, approximate location derived from IP;
18.1.5. Marketing and correspondence data — newsletter preferences, messages you send us, support tickets; and
18.1.6. Content you upload — images, text and other Member Content.
18.2. We collect data directly from you, from your use of the Platform, from other Members in the course of Residencies or sales (for example messages), and from service providers (for example analytics or payment providers).
19. How we use personal data and legal bases
19.1. We use personal data to:
19.1.1. provide and operate the Platform and Services (contract / legitimate interests);
19.1.2. create and manage Accounts, match Artists and Hosts, and fulfil orders (contract);
19.1.3. process payments and payouts (contract / legal obligation);
19.1.4. communicate with you about Residencies, orders and support (contract / legitimate interests);
19.1.5. send newsletters or marketing where you have opted in, or where otherwise permitted by law (consent / legitimate interests — you may opt out at any time);
19.1.6. improve the Platform, ensure security, prevent fraud and misuse (legitimate interests);
19.1.7. comply with legal obligations (legal obligation); and
19.1.8. establish, exercise or defend legal claims (legitimate interests / legal obligation).
20. Sharing personal data
20.1. We may share personal data with:
20.1.1. other Members as needed to arrange Residencies (for example sharing Artist and Host contact details once a match is confirmed);
20.1.2. service providers who help us operate the Platform (hosting, email, analytics, payment processing, printing and shipping partners), under appropriate contracts;
20.1.3. professional advisers and insurers where reasonably required; and
20.1.4. authorities where required by law or to protect rights, safety or property.
20.2. We do not sell your personal data.
21. International transfers
21.1. If we transfer personal data outside the UK, we will ensure appropriate safeguards are in place (such as the UK International Data Transfer Agreement or adequacy regulations), unless an exception under UK data protection law applies.
22. Retention
22.1. We retain personal data only as long as needed for the purposes set out in this Privacy Policy, including to fulfil orders, maintain provenance records for Editions, meet legal and accounting requirements, and resolve disputes. Retention periods vary by data type; you may request further detail by contacting us.

25.1. We use cookies and similar technologies that are necessary for the Platform to function, and may use analytics cookies to understand how the Platform is used. 26. Children
26.1. The Platform is not directed at children under 18. We do not knowingly collect personal data from children. If you believe we have done so, contact us and we will delete it where appropriate.

27.1. We may update this Privacy Policy from time to time. The “Last updated” date at the top of this document will change when we do. Material changes will be notified on the Platform or by email where appropriate.
